Terms of Service

These terms govern use of the EL ROAD Marketing website, our staffing platform, and the messages we send. By using any of them you agree to these terms.

Separate written agreements govern the work itself — a Partnership Agreement with clients and an employment or contractor agreement with brand ambassadors. Where those conflict with these terms, the signed agreement takes precedence.

Who we are

EL ROAD Marketing, 299 E Thousand Oaks Blvd, Suite 232, Thousand Oaks, CA 91360. We provide in-store product demonstration and field marketing services.

Platform accounts

Accounts are individual and must not be shared. You are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you believe someone else has access.

Accounts are created by approval. Applying does not entitle you to an account, and we may decline or close an account at our discretion.

You agree not to attempt to access data belonging to another user, interfere with the platform's operation, or use it for any purpose other than the work it exists to support.

Accuracy of what you submit

Information submitted through the platform — reports, photographs, receipts, unit counts, certifications and expiry dates — must be truthful and current. Submitting false information is a material breach of your agreement with us.

Text messages

If you opt in, EL ROAD sends text messages about your work: shift offers and confirmations, arrival reminders, check-in prompts, requests for a photograph or receipt during a demo, document expiry reminders, and payment notifications. We do not send marketing or promotional text messages.

Message frequency varies with how many demos you work. Message and data rates may apply.

Reply STOP to any message to cancel. You will receive one confirmation and no further texts. Reply HELP for assistance, or contact us on 424-786-1124.

Carriers are not liable for delayed or undelivered messages.

Opting out is not a penalty. Anyone who opts out receives the same scheduling information by email.

Mobile numbers and messaging consent are never sold, rented or shared with third parties for marketing purposes.

Intellectual property

The EL ROAD name, logo, website and platform are our property. Photographs and reports produced during a demo belong to EL ROAD and the client who commissioned it, and may be used in client reporting and marketing. Do not post photographs of a demo, a store or a client's product publicly without our written permission.

Client obligations

Clients are responsible for supplying product to stores in time for scheduled demos, for providing any certificate of insurance a store requires, and for the accuracy of product information including allergens and age restrictions. Cancellation and product-supply terms are set out in the signed Partnership Agreement.

Availability

We aim to keep the platform available at all times but do not guarantee uninterrupted service. We may suspend access for maintenance, and we are not liable for losses arising from unavailability.

Limitation of liability

To the extent permitted by law, EL ROAD is not liable for indirect, incidental or consequential losses arising from use of the website or platform. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence.

Privacy

Our Privacy Policy explains what we collect and how we use it, and forms part of these terms.

Changes

We may update these terms. The date at the top will change, and material changes will be notified to account holders by email. Continuing to use the platform after a change means you accept it.

Governing law

These terms are governed by the laws of the State of California. Any dispute will be resolved in Ventura County, California.
