Privacy Policy

EL ROAD Marketing ("EL ROAD", "we", "us") provides in-store product demonstration and field marketing services. This policy explains what personal information we collect, why we collect it, and how we look after it.

It applies to our website, our staffing platform, and the text messages and emails we send.

SMS and mobile information

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

EL ROAD Marketing does not sell, rent, lease or share mobile phone numbers or SMS consent with any third party, affiliate, or partner for marketing or promotional purposes, under any circumstances.

Mobile numbers are used only to send the work-related messages described in the Text messages section below, and are disclosed only to our messaging service provider for the sole technical purpose of delivering those messages on our behalf.

You may opt out of text messages at any time by replying STOP to any message. Reply HELP for assistance. Message and data rates may apply. Message frequency varies.

Who this covers

We hold personal information about three groups:

What we collect

From brand ambassadors: name, email address, mobile number, home city and state, date of birth where required for age-restricted products, food handler card and alcohol service certification with expiry dates, driver's licence, bank details for payment, tax identification, a photograph, and records of work performed including check-in and check-out times and locations, photographs taken at demos, receipts, and reports submitted.

From clients: business contact details, product information, store lists, insurance certificates, and billing information.

Automatically: basic technical information when you use our platform, such as browser type and the times you sign in.

Location information

Where a brand ambassador is working a scheduled demo, our platform records location at check-in, at check-out, and at intervals during the booked shift. This is used solely to confirm attendance at the correct store and to verify hours for payment.

We do not record location between demos, outside booked hours, or when the app is not being used for a scheduled shift. Consent to this is given in writing in the contractor or employment agreement before any work begins.

Text messages

Brand ambassadors choose during onboarding whether to receive text messages. The options are presented plainly and consent is recorded with a timestamp.

Text messages we send relate to work only: shift offers and confirmations, arrival reminders, check-in prompts, requests for a photograph or receipt during a demo, document expiry reminders, and payment notifications. We do not send marketing or promotional text messages.

You can stop text messages at any time by replying STOP to any message, or by changing the setting in your platform account. Reply HELP for assistance. Message and data rates may apply. Message frequency varies with how many demos you work.

We do not sell, rent or share mobile numbers or text message consent with any third party for marketing purposes. Mobile information is not shared with third parties or affiliates for their own marketing or promotional use. Numbers are shared only with our messaging provider for the sole purpose of delivering the messages described above.

Anyone who opts out of text messages receives the same scheduling information by email instead. Opting out does not affect eligibility for work.

Why we use it

What clients see

Clients receive reports on demos run for them. These include the brand ambassador's first name only, photographs of the shelf and display, units sold, and shopper feedback. Clients do not receive contact details, addresses, pay rates, performance scores or any document from a brand ambassador's file.

Who else we share with

We share personal information only where it is necessary:

We do not sell personal information, and we have not sold or shared personal information in the preceding twelve months.

How long we keep it

Work records, reports and payroll records are kept for as long as required by tax and employment law, generally at least four years. Photographs from demos are available to clients for eighteen months and archived after that. Applications from people we do not engage are deleted after twelve months. You may ask us to delete your information sooner where we are not required to keep it.

How we protect it

Platform accounts are individual and password-protected. Access is restricted by role, enforced at the database level, so a brand ambassador can only reach their own records and a client only their own brand. Data is encrypted in transit and at rest. Bank and tax details are held by our payroll provider rather than by us.

Your rights

If you are a California resident, the California Consumer Privacy Act gives you the right to know what personal information we hold about you, to request a copy, to ask us to correct or delete it, and to opt out of any sale or sharing of it — noting that we do not sell or share personal information. You may also limit the use of sensitive personal information. We will not discriminate against you for exercising any of these rights.

Children

Our services are not directed at children and we do not knowingly collect information from anyone under 18.

Changes

If we change this policy we will update the date at the top of this page. Material changes will be notified to platform account holders by email.
